Tell developers to drop their legal challenge against local green building policies

A developer lobby group in Ontario is suing Toronto for its Green Development Standards which are meant to improve efficiency and resiliency while bringing down pollution and monthly energy costs in new homes and other buildings.

The result of the legal challenge will impact more than a dozen municipalities in Ontario that are using Green Development Standards to protect the health and wallets of residents. These municipalities are rightly exercising their local authority to ensure new buildings are less polluting and more community-friendly.

I am an Ontario resident and I am appalled that RESCON is suing Toronto for its Green Development Standards.

As a member of the board of directors, you can instruct RESCON to drop this senseless legal challenge. I ask that you do so immediately.

Builders the world over are adopting modern building technologies and showing they can be more resilient, community-friendly, more affordable to live in, and healthier.

While Canadian and provincial building codes are lagging behind the times, Ontario municipalities have taken the responsible step to guide building construction in a way that benefits people, nature, and the climate.

Municipalities have the legal authority to implement such local policies under the Municipal Act, the City of Toronto Act, and the Planning Act. Local leaders are rightly using their jurisdictional power to help move Ontario into the modern building era.

In contrast to industry arguments, data shows that Green Development Standards do not slow down housing construction and do not significantly increase building costs. Using such standards makes homes more resilient in the face of floods and heat waves while making them healthier for people to live in with improved air quality.

This is why fifteen Ontario municipalities have introduced Green Development Standards, with many more exploring the option. As a result, a new positive norm is taking root in the province.

By legally challenging Toronto’s Green Development Standard (and by extension all others in Ontario), you are disrupting progress and trampling on municipal jurisdiction. Rather than supporting the building of modern, healthy, and resilient homes, you are taking Ontario backwards.

As a board member of RESCON, you should be concerned about its reputation, as well as that of your own company.

I want to live in a home that is green, efficient, future-proof, and community-friendly.

I support developers and construction companies that are future-thinking and using the latest technologies.

RESCON and your own construction company should be leaders in the building sector, setting a positive standard for Ontario.

I ask you to make a responsible decision and direct RESCON to drop this frivolous and harmful legal pursuit.
